The Client – is the person named on the booking form. The Client takes full responsibility for the goods under the following terms and conditions.
The Company – is Ivy and Oak Event Hire
When hiring our items you automatically agree to the following terms and conditions.
All items remain the property of Ivy and Oak Event Hire
All prices listed online are subject to change without any prior notice.
In the event of price increase we will honour the written quotation for 7 days. If the booking fee has not been paid and the Booking Form/T&Cs have not been received, the quotation will be amended to the new price.
The hire period will be based upon whether we have an event the next day and what the venue wishes.
IMPORTANT
It is the Clients responsibility to ensure the correct use of the games.
Children must be supervised at all times.
The client is also responsible for gathering items such as beanbags, ducks, rods, clubs and balls ready for our collection. Failure to do so can lead to missing items which you will be charged for and if we have to spend time looking over our pack down time of 45 minutes, you will be charged for our time.
Booking fee/Deposit
All hire purchases require a 40% non-refundable deposit to secure the booking. Both the booking fee/deposit must be paid and the contract signed before a booking is confirmed. You have 5 days to do this.
Damages, Loss And Breakages Deposit
A refundable damage deposit is required at the time of final payment and is dependent on the total cost of your package. This is in addition to the hire fee. Once the items have been received back we will check them for damage and if fine, the damage deposit will be returned within 14 working days. The items (including games, decor, signage, sundries such as balls, bean bags, clubs, rods etc..) must be received back in the same condition they were delivered. Any cleaning costs will mean a loss of your damage deposit for the cleaning cost amount.
If any items are returned dirty you will be charged 20% of the hire value of the items as a cleaning fee.
If any games, decor or additional items are damaged or lost the cost of the replacement part or game will be deducted from your deposit. If this fee is higher than the deposit you will be invoiced for the balance. This balance is to be paid within 7 days. After 7 days 10% interest will be charged. After 1 month you will incur a 15% interest charge. After 2 months a further 15% will be added. We will then seek legal action to cover the cost. The costs of these legal fees will be added to the invoice. By signing the contract you agree to these terms. The client hiring the games will be liable for any damage or loss.
Substitute items will not be accepted and all damaged items remain the property of Ivy and Oak Event Hire and should therefore be returned.
We reserve the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.
We can provide you with a Damaged or Lost Items Price List which is updated approximately every 6 months.
Cancellations
Please contact Ivy & Oak Event hire if you wish to cancel your booking. Any cancellations must be made in writing.
You will incur a cancellation charge based upon the value of the balance owed. This amount is dependent upon the length of notice we receive from you.
If you cancel your booking 14 days before the date 100% of the balance will be owed.
If you cancel your booking 15-60 days before the date 50% of the balance will be owed.
Game Usage
The client agrees to use all items appropriately and will not allow others to damage or use the equipment recklessly.
Please do not allow smoking, eating or drinking near the equipment and keep away from fire.
The games may not be used by the Client commercially, sold on, used for prize giving or for anything other than their intended purpose.
Giant Jenga
Children must be supervised at all times. It is not suitable for under 8’s.
It works best on a flat surface but may not be placed on stone or concrete flooring as this can damage the pieces. For indoor use we have soft mats for it to go on.
Delivery and Set up
The package includes set up and take down fees. We will also collect the items at the end of the hire period. You must have all items returned to their original boxes/crates ready for us to pick them up. If we need to spend extra time searching for items you will be charged for our time.
Package costs include delivery within 20 miles of NN3 5GB (This covers a 40 mile round trip). Other delivery costs will be charged at £1.50 per mile.
Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.
It is the responsibility of the client to give appropriate parking information to the company. If there are parking costs, these will be added to your invoice. Any parking permits will need to be given to the company prior to the delivery date.
Deliveries must be inspected upon receipt. Any shortages, breakages or incorrect items must be notified to the Company within 2 hours (same day) of receipt. This enables us to put things right in good time. No claims for breakages, loss or incorrect items can be entertained beyond this time period.
Liability
Please note that all persons using the games do so at their own risk. The client will be held responsible and liable for any damage or injury occurring from a result of misuse or reckless use.
In no circumstances shall our liability to you exceed the invoice value of the contract.
When our games are set up outside we cannot and will not be held responsible for any damage to the lawns. The client will be held responsible.
We cannot be held liable for bad weather. If you cannot use the outdoor games in the time allotted due to weather, no refund will be given. In the event of strong winds it is recommended to not use the outdoor games and to move them to a protected area for your safety. If allowed by your venue and there is space, we may be able to set up the games indoors.
Ivy and Oak Event Hire cannot and will not except any responsibility for any damage to venue or injury to a person.
We hold Public Liability insurance.
